Why you consider the Draft Local Plan is not legally compliant or is unsound or fails to comply with the duty to co-operate

The plan is unsound for a number of reasons as in various aspects it`s adoption in it`s current form will lead to the distruction of vital environmental features and increase the risk of flooding in areas adjacent to several of the proposed developments. There also the question of area quality and the Council`s own admission and declaration of an environmental emergency the increased traffic flow and inevitable congestion of the proposed 656 development for example will caused the direct health risk to the population and will deprive them of their right to have both their environment and health protected that in itself could be considered and illegal and unsound act . In addition to this the plan is unsound as government has stated that no green belt should be released until all suitable field sites have been developed. As such the plan should be withdrawn and re-worked to meet these objectives

The plan to build 480 houses on Thelwall Heys is floored in as much as run off from these houses will direct run in to existing high flood risk areas in Thelwall and the existing culverts and water courses taking water toward the Manchester ship canal are insufficient there is a major flooding problem as it is in the land direct below the proposed development building that number of houses there is environmentally irresponsible, there is also the matter of road infrastructure that will not be able to cope This in conjucction with the 656 development will create congestion and resulting air pollution in addition the flooding and erosion risk

Modification if applicable

In light of New guidance and policy outlined by the government in terms of protection of Green Belt and the right of the population to have their air quality and health protected then the plan needs to be remodelled taking these fresh guidelines into account.
